COLLABORATIVE
DIVORCE

Collaborative Divorce is a new, court-created process for a non-litigated divorce.  You don't have to sue your spouse anymore!  The court rules were created after years of judges, attorneys and spouses saying, "there must be a better way!"  Grand River Legal will help you figure out what your life will look like after separation. There are four phases to a Collaborative Divorce at Grand River Legal:

  • Get us your information:  Submit your Confidential Divorce Questionnaire and documents to us. This includes employment, financials and schedules. Grand River Legal has a confidential and encrypted client portal for providing this information.  If Subpoenas are needed to obtain information that option is available as well.                                                  

  • Pre-Facilitation Consultation:  Grand River Legal will take your information and discuss with you the many options for your Collaborative Divorce Facilitation.  We look at issues you and your spouse have agreement on and  then determine the best plan forward for reaching agreement on the others.

  • Collaborative Facilitation Your Collaborative Attorneys will work with you through the process of negotiating your divorce settlement.  Through negotiation and compromise, and an infusion of reality from the Collaborative Attorneys, a settlement can be reached.  Your Collaborative Facilitation will allow you to agree on your children's new schedules, how your assets may be split and how child support should be paid.  With the advice your Collaborative Divorce attorney you can work out all the terms of your divorce.  When a settlement is reached an agreement is drafted and signed by both parties and the hard work is done.                                                           

  • Filing Court Papers: Basically, your Divorce Settlement Agreement from your facilitation becomes your Divorce Judgment.  But your Divorce Judgment needs to be in a form and contain the proper legal language to be recognized by the court and signed by a judge.  Grand River Legal can take care of this for you.  We will file all the proper paperwork for you in any Michigan jurisdiction.                                 

How does a Facilitated Divorce work under Michigan Law?

The short answer is, it works for almost all couples who want to save money and time while protecting and preserving the family unit for their children.
